How is it legal for TV shows like Deal or No Deal and Games Fever to charge money for text messaging?
Current TV shows like Deal or No Deal, The Apprentice and Games Fever offer contests during their programs where you can enter via a text message that costs 99 cents. It is illegal to have a contest where you charge an entry fee and make a profit (unless you are a non-profit company). So how do these tv shows get away with it?

Because they also offer a non-fee way of entering via the internet. Sometimes they say it but usually it's in the small print at the bottom of the screen.

You assume that one thing has anything to do with the other. The money goes to the phone survey people directly and they in turn give the information to the television show that gives away the prize money. The 99 cents is a charge for the convenience of doing it on phone. You can always do it online for free with the show itself. If you think about it you are paying for the phone bill as well so add that into the expense of winning.
